RELEASE OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT
By participating in a class, session, party or event (each, an “Event”) at
B.E.S.T. Wellness Studio (Bellapuppies Entertainment Strive Together),
Hackensack, New Jersey, operated by
Bellapuppies LLC (doing business as Bellapuppies NYC and
B.E.S.T. Wellness Studio), involving yoga or other physical activity and interaction
with live animals (puppies and dogs), I agree to the following.
1. Assumption of risk
I understand the Event involves inherent risks including, without limitation: slips and falls,
sprains and strains, collisions, allergic or asthmatic reactions, scratches and bites,
illness or exposure to germs, dander and saliva, and animal unpredictability. I voluntarily
assume all risks, known and unknown, related to my participation.
2. Release of liability
To the fullest extent permitted by law, I release and hold harmless Bellapuppies LLC,
doing business as Bellapuppies NYC and B.E.S.T. Wellness Studio, and its owners, members,
instructors, breeders and handlers, staff, contractors, agents, affiliates, partners and
the venue or studio premises
(together, the “Released Parties”) from any and all claims arising from my
participation, including claims based on ordinary negligence. This does not apply to gross
negligence or willful misconduct, or where such a release is prohibited by law.
3. Health and emergency care
I confirm I am physically able to participate and am responsible for my own health and
safety. If needed, I authorize studio or venue staff to obtain emergency medical treatment
for me, and I am responsible for the related costs.
4. Safety rules and removal
I agree to follow all instructions given by instructors, handlers and staff. The studio may
refuse entry or remove me without refund if my conduct is unsafe, disruptive, intoxicated,
aggressive or non-compliant.
5. Animal contact
I will handle the puppies and dogs gently and only as directed. I understand that animals
are living creatures whose behavior cannot be guaranteed, that I should not pick up or
restrain an animal unless told I may, and that I must report any scratch, bite or injury to
staff before I leave.
6. Indemnity
I agree to indemnify and defend the Released Parties against any claims, damages or costs,
including reasonable attorneys’ fees, arising from my actions, my rule violations or
any false statement I make in this document.
7. Photo and video consent
I grant Bellapuppies LLC the irrevocable right to photograph
and record me at the Event and to use those images, video and audio for promotion,
advertising, social media and other business purposes, without payment to me, unless I
decline below. Declining will not prevent me from participating.
8. Personal property
I am responsible for my own belongings. The Released Parties are not liable for loss,
theft of or damage to personal property brought to the studio.
9. Participants under 18
If I am signing for a participant under 18, I confirm I am that participant’s parent
or legal guardian, I accept all of the terms above on their behalf as well as my own, and I
agree to supervise them throughout the Event.
10. Governing law and severability
This agreement is governed by the laws of the State of New Jersey, and any dispute will be
brought in the state or federal courts serving Bergen County, New Jersey. If any part of this
agreement is held unenforceable, the rest stays in full force.
11. Acknowledgment
I have read this document in full. I understand it is a release of legal rights and a
contract, and I sign it freely and voluntarily. I confirm the information I have given is
true, and that I am at least 18 years old, or the parent or legal guardian of every
participant named above.
